Welcome to The Modern Woman. The terms “we”, “us” and “our” refer to The Modern Woman (operated by Modern International Group). We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you with a curated shopping experience (the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced in them (including our Privacy Policy and our Returns & Refunds Policy), set out your rights and responsibilities when you use the Services.

Please read these Terms carefully. By visiting, interacting with, or using our Services (including placing an order), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

SECTION 1 — ACCESS AND ELIGIBILITY

By using the Services, you confirm that you are 18 years of age or older and legally capable of entering into a contract.

You may be asked to provide certain information when using the Services or placing an order, such as your name, email address, billing and shipping address, and payment details. You confirm that all information you provide is true, accurate, current and complete, and that you have the right to provide it.

If you create an account, you are responsible for maintaining the security of your account credentials and for all activity under your account. You must not transfer, sell, assign, or license your account to any other person.

We may suspend or restrict access to the Services where we reasonably believe there has been misuse, unlawful activity, or a breach of these Terms.

SECTION 2 — OUR PRODUCTS (SUPPLEMENTS)

We make every effort to display our products as accurately as possible. However, product appearance, colour and packaging may vary slightly depending on your device display and updates to labels or manufacturing batches.

Our products are food supplements. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Information provided on our website is for general information only and does not replace professional medical advice.

If you are pregnant, breastfeeding, taking medication, have an underlying medical condition, or are under medical supervision, you should consult a GP or qualified healthcare professional before use. Always follow the suggested use on the label and do not exceed the recommended intake. Stop use if you experience any adverse reaction.

We reserve the right to change product descriptions, pricing, and availability at any time, and to discontinue products without notice.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. Orders are subject to acceptance and availability. We may accept or decline an order at our discretion, including (without limitation) where:

  • a product is out of stock

  • there is a pricing or listing error

  • we suspect fraud or unauthorised activity

  • we cannot verify order information

An order is not accepted until we confirm acceptance (for example, by dispatching the product or sending an acceptance confirmation). We must receive and process payment before an order is accepted.

Please review your order carefully before submitting. We may be unable to accommodate cancellation requests once an order has been accepted or dispatched.

If we cancel or refuse an order after payment has been taken, we will issue a refund for the amount paid.

Your purchases are subject to returns and refunds in accordance with our Returns & Refunds Policy, in addition to your statutory rights.

You confirm purchases are for personal or household use only and not for commercial resale, redistribution, or export without our written permission.

SECTION 4 — PRICES, BILLING AND PAYMENT

Prices are shown in GBP. If VAT becomes applicable, it will be displayed clearly at checkout.

Shipping costs (and any other charges) are calculated at checkout.

Prices, discounts and promotions may change without notice. The price charged will be the price shown at checkout at the time you place your order.

Payment methods available will be displayed at checkout. Payments are processed securely via Shopify and/or its payment providers. We do not store your full payment card details.

You agree to provide current, complete and accurate purchase and account information and to update it promptly as needed.

SECTION 5 — SHIPPING AND DELIVERY

Shipping options, estimated delivery times and costs are shown at checkout. Delivery times are estimates and are not guaranteed.

We are not responsible for delays caused by shipping carriers or events outside our reasonable control (including severe weather, strikes, operational disruptions, or peak postal periods).

Risk in the products passes to you upon delivery to the address provided at checkout.

SECTION 6 — INTELLECTUAL PROPERTY

All content and materials made available through the Services, including (without limitation) trademarks, branding, text, images, graphics, product reviews, video, audio, and the design and arrangement of the Services, are owned by The Modern Woman, Modern International Group, or our licensors, and are protected by UK and other applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not copy, reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any part of the Services without our prior written permission, except as permitted by law.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools or features offered by third parties. We do not monitor or control these tools and provide them “as is” and “as available”, without warranties or endorsements. Your use of third-party tools is at your own risk and subject to the third party’s terms.

The Services may contain links to third-party websites or platforms. We are not responsible for third-party content, policies, accuracy, or availability. If you choose to access third-party sites, you do so at your own risk.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

The Modern Woman is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Modern Woman. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Modern Woman, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Modern Woman.

SECTION 10 — PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify may also collect and process personal data about your access to and use of the Services in order to provide and improve the Services for you.

SECTION 11 — FEEDBACK AND REVIEWS

If you submit reviews, comments, ideas, suggestions, or other content (“Feedback”), you grant us a worldwide, royalty-free, perpetual, sublicensable licence to use, reproduce, modify, publish, distribute and display such Feedback for purposes including operating, improving and promoting the Services.

You confirm you own or have the necessary rights to any Feedback you provide and that it does not infringe third-party rights or contain unlawful, abusive, or harmful content. We may remove Feedback at our discretion.

Occasionally, the Services may contain typographical errors, inaccuracies or omissions related to product descriptions, pricing, promotions, shipping charges, transit times and availability. We reserve the right to correct these and to cancel orders where necessary (including after an order has been submitted). Where payment has been taken for a cancelled order, we will refund it.

  • misuse the Services, attempt unauthorised access, or interfere with security features

  • upload malicious code or attempt to disrupt the Services

  • engage in any activity that could harm The Modern Woman, Shopify, or other users

We may suspend or terminate access where we reasonably believe a breach has occurred.

We may terminate or suspend your access to the Services at any time if you breach these Terms. Termination does not affect any rights or obligations that, by their nature, should survive termination (including intellectual property, warranties/disclaimers, and liability limitations).

The Services and all products offered through the Services are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

Nothing in these Terms affects your statutory rights as a consumer.

SECTION 16 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Services or products, including loss of profits, loss of revenue, loss of data, or business interruption.

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless The Modern Woman, Modern International Group, and our affiliates, officers, directors, employees, agents, contractors and service providers from losses, damages, liabilities and reasonable legal fees arising out of your breach of these Terms, your unlawful use of the Services, or your violation of any rights of a third party.

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will continue in full force and effect.

SECTION 19 — ENTIRE AGREEMENT

These Terms and any policies referenced constitute the entire agreement between you and us in relation to your use of the Services and supersede prior agreements or communications.

SECTION 20 — ASSIGNMENT

You may not assign your rights or obligations under these Terms without our written consent. We may assign or transfer our rights and obligations under these Terms as part of a business transfer or reorganisation.

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over any dispute arising out of or in connection with these Terms or the Services.
